Indemnification is a form of compensation that supports a buyer (you) if a copyright claim is made against a purchased asset. One party (Pond5) agrees to pay for potential losses or damages caused by another party (the claimant).
If a legal claim is made against media you’ve licensed from Pond5, we will stand between you and the claimant and cover legal costs in defending the claim, liability from the claim, and settlements paid from the claim (regardless of whether the claim is valid or not).
Please keep in mind that every single asset that’s published on Pond5 is vetted through our best-in-class curation process, so you can license and create worry-free! In the unlikely event an issue was to occur, indemnity offered by Pond5 covers legal costs incurred in defense of the claim, liability from the claim, and settlements paid.
Why would I want to purchase indemnification?
Many buyers, particularly at the enterprise level, require indemnification for the media they license as a legal requirement for producing new work. Our Individual License offers industry-leading indemnification for up to $15K, our Business License offers up to $250K, and the Premium license is up to $1 million. We offer these options on every single asset on Pond5!
The License and ultimately Indemnification choice depends on the nature of the project and its audience.
